Ethiopia: End State of Emergency restrictions on political dissent and targeting of human rights defenders

The Association for Human Rights in Ethiopia (AHRE) is deeply concerned with the wide-ranging restrictions the state of emergency decree has enabled, which severely affect freedom of expression, freedom of assembly, association and peaceful protest in Ethiopia. Ethiopia’s close allies and partners in the international community unequivocally condemn the grave violations of human rights in Ethiopia and the misuse of the directive to silence political dissents, to threaten and systematically targeting journalists, bloggers, human rights activists and peaceful protestors across the country.

Since, the six-month nationwide State of Emergency was declared on October 9, 2016, tens of thousands of individuals have been arrested arbitrarily arrested. Dissent and independent reporting on the state of emergency directives has been quashed through the arrest of journalists, bloggers, human rights activists and opposition leaders and their members. On 12 November 2016 the Ethiopian the authorities have announced that they arrested some 11, 607 people since the declared state of emergency was enforced. However, different sources on the ground confirmed that the number of arrests is in reality much higher. According to AHRE, nearly twenty thousand people have been arrested in Oromia region, and over fifteen thousand have been arrested in Amhara region, notably in Gondar and Gojjam.

Our sources on the ground confirmed that most the authority has use harsh treatments in those detention centers, including denying medical treatments while knowing that the location of most of these prison centres are affected by high degree of malaria. Our sources confirmed most of the prisoners are suffering with malaria and other related infection with lack of medical attention. Prisoners are also forced to do some heavy military exercises for the purpose of punishment. The whereabouts of most of the detainees are also unknown, and access to information has been severely limited by a two month long suspension of 3G mobile internet network in several regions, including the capital Addis Ababa.

On 18 October 2016, journalist Abebe Wube, the general manager of ‘Ye Qelem Qend’ newspaper, was arrested in Addis Ababa, by security forces. On 11 November 2016, police detained one of the Zone 9 bloggers and a co-founder of the collective, Befiqadu Hailu, who received the 2015 CPJ’s International Press Freedom Award from his parents’ house in Addis Ababa. It is also reported by CPJ[1] that Befekadu was arrested in relation with an interview that he gave to the U.S. government-funded broadcaster Voice of America’s Amharic service, criticizing the government’s handling of protestors.

On 18 November 2016, former leader of UDJ, Daneil Shibeshi with other two journalists Elias Gebru and Ananiya Sori were arrested by security forces. The outspoken journalist and former political activist Ananiya Sori was arrested following his recent critic against the policy of the government and its reaction during the large protest in the country on a radio debate that was organized by the pro-government media, Fana Broadcasting, in October 2016.

CPJ also reported about the disappearance of Abdi, Gada in its report. Abdi is an unemployed television journalist who disappeared since November 9 and his family fear that he might be arrested. On 31 November 2016, prominent opposition party leader Dr, Merera Gudina, Chairman of the Oromo Federalist Congress (OFC) was arrested upon his return from Europe after he delivered a speech to members of the European Parliament, in Brussels, on the current situation of Ethiopia.

Three of the main opposition parties, the Unity for Democracy and Justice (UDJ), Blue Paty and All Ethiopian Unity Party (AEUP) have claimed that a large number of their leaders and members were targeted by the Command Post and arbitrary arrested. It is reported that tens of UDJ members were arrested during and before the state of emergency announced. AEUP reported that around 20 of its members were arrested in the last few weeks. Blue Party also reported to AHRE that 23 of its members including three leaders of the party, Bilen Mesfin, Abebe Akalu (teacher) and Yidnekachewu Kebede (lawyer) were arrested under the order of the Command Post. AHRE also informed about the criminal charge of the Wolqayit Committee members who have been targeted by security forces since the beginning of the popular protest in Amhara region, particularly in Gonder and Gojam, in July 2016. Including Colonel Demeqe Zewude, other members of the committee have faced criminal charge under the 2009 anti-terrorism law of Ethiopia.

In addition, the authorities have not given any information on the thousands who have been arbitrarily arrested since November 2015 throughout Oromia and Amhara regions during and after the protests. There has been no international, independent, and impartial investigation into allegations of the security forces’ use of excessive and unnecessary lethal force to disperse and suppress peaceful protests that costs the life of hundreds. According to Amnesty International recent report released on 18 November 2016 heavy-handed measures by the Ethiopian government risk escalating a deepening crisis that has claimed the lives of more than 800 protesters. [2]  On 4 November 2016, the African Commission on Human and Peoples’ Rights adopted a resolution calling for the government to authorize the Commission to conduct a fact-finding mission to Ethiopia.

The state of emergency directive gives ultimate power to the Command Post that has appointed by the House of Representative to enforce the decree, including suspending basic and fundamental political and democratic rights granted under the constitution of the country, the African Charter on Human and People Rights and international standards of human rights.

AHRE strongly urges the Ethiopian government:
  • to lift the ban on basic freedoms and fundamental rights that are enforced by the authorities and Command Post following the declaration of the state of emergency;
  • to immediately and unconditionally release all political prisoners, journalists, bloggers, human rights activists and opposition leaders;
  • to ensure due process of law for those who were arrested before and during the time of the state of emergency and to respect basic rights of prisoners,
  • to allow independent and impartial investigation into allegations of gross human rights violation during the enforcement of the state of emergency and since November 2015 when the protest were began.

DROI Chair shocked at arrest of leading Ethiopian opposition figure Prof. Merera Gudina after his recent meeting with MEPs

The Chair of the European Parliament’s Subcommittee on Human Rights (DROI), Elena Valenciano (S&D, ES), made the following statement:

“On 30 November Ethiopian security forces detained the chairman of the Ethiopian opposition party ‘Oromo Federalist Congress’ (OFC), Professor Merera Gudina, shortly after his arrival in
Addis Ababa.

Prof. Merera was returning from Brussels where - together with other Ethiopian activists and the Olympian athlete Feyisa Lellisa - he had had a meeting with MEPs on 9 November 2016.

I urge the Ethiopian Government to make public any charges it has brought against Prof. Merera and I will continue to follow his case very closely.

The European Parliament adopted an urgency resolution on the violent crackdown on protesters in January 2016, which requested that the Ethiopian authorities stop using anti-terrorism legislation to repress political opponents, dissidents, human rights defenders, other civil society actors and independent journalists.

Since January 2016 the human rights situation in Ethiopia has not improved at all. Human Rights Watch reports that security forces have killed more than 500 people during protests over the course of 2016. Moreover the state of emergency has led to further significant restrictions on freedom of expression, association, and assembly. I therefore reiterate Parliament’s demands as set out in its resolution.

The European Parliament is aware of the difficult situation in Ethiopia and stresses the need to continue to support the Ethiopian people.”

U.S. accuses Ethiopan gov’t of using martial law to silence dissent

The United States says the Ethiopian regime is using the martial law it declared in October to silence dissent. Deputy spokesperson for the United States Department of State Mark Toner said on Thursday that the arrest of Dr. Merara Gudina, Chairman of the Oromo Federalist Congress, was “yet another example of increasing restrictions on independent voices in Ethiopia.”

Toner went on to say that the arrest of Gudina upon his return from Europe, where he spoke against the tyrannical regime in his country in a testimony at the European Parliament, “further reinforces our view that Ethiopia’s declared state of emergency is perhaps being used to silence dissent and deny the constitutionally protected rights of Ethiopia’s citizens.”

Dr. Gudina was arrested in Addis Ababa upon his return from Europe following a campaign by the state affiliated media for his arrest saying  he had violated the martial law when he testified against the regime along with Prof. Berahnu Nega, the leader of Patriotic Ginbot 7, an armed group fighting the regime. PG7 is outlawed by the iron fist government that doesn’t allow independent political organizations, which are a threats to its rule.

ጠቅላይ ፍርድ ቤት በነሃብታሙ አያሌው መዝገብ ላይ ውሳኔ አስተላለፈ

* አብረሃ ደስታና ዳንኤል ሺበሺ ወደእስር ቤት ይመለሳሉ። 
* ሐብታሙ አያሌውና የሺዋስ አሰፋ ነፃ ተብለዋል።

ከፍተኛ ፍርድ ቤት በነፃ ባሰናበታቸው 5ት ተከሳሾች (ሃብታሙ አያሌው፣ ዳንኤል ሺበሺ፣ አብረሃ ደስታ፣ የሽዋስ አሰፋ እና አብረሃም ሰለሞን) ላይ አቃቢ ህግ ለጠቅላይ ፍርድ ቤት ይግባኝ ብሎ አመት ከ3ወር በላይ በቀጠሮ ሲራዘም የነበረው ጉዳይ ዛሬ ብይን ተሰጥቶበታል።

ዳኞች በአራቱ ተከሳሾች ላይ ማለትም፤ ሃብታሙ አያሌው፣ ዳንኤል ሺበሺ፣ አብረሃ ደስታ እና የሽዋስ አሰፋ ላይ ከደህንነት መስሪያ ቤት የቀረበባቸውን የሽብርተኛ ድርጅት አባል ከሆኑ ግለሰቦች ጋር ካደረጉትን የስልክ ልውውጥ በመርመር ነው ውሳኔ የሰጡት። በዚህም መሰረት ሃብታሙ አያሌው ያደረጋቸው የስልክ ልውውጦች ሲታዩ በሽብርተኛ ድርጅት የተፈረጁ ድርጅቶች አባላት ጋር የተደረገ ቢሆንም “በሰላማዊ መንገድ ሁኔታዎችን ለመለወጥ እና ዲሞክራሲያዊ ስርአት ስለመገንባት” የሚያወሩ በመሆኑ የስር ፍርድ ቤት ውሳኔ ትክክል ነው ብለው በነፃ እንዲሰናበት ወስነዋል።


ዳንኤል ሺበሺ እና አብረሃ ደስታ ከፋሲል የኔአለም ጋር ያደረጉት የስልክ ልውውጥ ሲታይ በክሱ እንደቀረበው የሽብር ተግባር ሊፈፅሙ ባያቅዱም፤ በሽብርተኛ ድርጅት ከተፈረጀው ግንቦት 7 ጋር ሁለገብ ትግል በሚለው ሃሳብ የመስማማት አዝማሚያ እንዳላቸው እና ከሰላማዊ ትግል ባለፈ የመንቀሳቀስ ፍላጎት እንዳላቸው እንደሚያሳይ ገልፀዋል ዳኞቹ። ስለሆነም የፀረ ሽብር አዋጁ አንቀፅ 7(1)ን የእንዲከላከሉ ሲሉ ብይን ሰጥተዋል።


የሽዋስ አሰፋም እንዲሁ ከፋሲል የኔአለም ጋር ያደረገውን የስልክ ምልልስ እንዳዩት የገለፁት ዳኞቹ፤ የሽብር ድርጊት ለመፈፀምም ሆነ በሽብርተኛ ድርጅት ውስጥ ለመሳተፍ ፍላጎት እንዳለው ስለማያሳይ በነፃ እንዲሰናበት ተበይኗል።


አብረሃም ሰለሞንን በተመለከተ የቀረበ የተጠለፈ የስልክ ልውውጥ ከደህንነት የቀረበ ሪፓርት ስላልነበረ፤ በቀረቡት የአቃቢ ህግ ምስክሮችን መሰረት አድርገው ነው ዳኞች ውሳኔውን የሰጡት። ከአቃቤ ህግ ምስክሮች ተከሳሹ በመንግስት ላይ ያለውን ጥላቻ እና በግንቦት 7 እየተሳበ መምጣቱን መመልከት ይቻላል ሆኖም ግን በአባልነት ስለመመልመሉ እና ስለተሳትፎው የተገለፀ ነገር ባለመኖሩ በነፃ እንዲሰናበት ወስኗል።

በዛሬው ችሎት ላለፉት በርካታ ጊዜያት በህመም ምክንያት ችሎት ሳይቀርብ በተወካዩ አማካኝነት ጉዳዩን ሲከታተል የነበረው ሃብታሙ አያሌው ከህመሙ በመጠኑ አገግሞ በችሎት የተገኘ ሲሆን አብረሃ ደስታ ደግሞ እዛው መቀሌ የሚገኝ ፍርድ ቤት በፕላዝማ ችሎቱን ተከታትሏል። በአስቸኳይ ጊዜ አዋጁን ጥሰሃል በሚል በእስር የሚገኘው ዳንኤል ሺበሺ ችሎት ሳይቀርብ ቀርቷል።

በፀረሽብር አዋጁ አንቀፅ 7(1) እንዲከላከሉ የተበየነባቸው አብረሃ እና ዳንኤል፤ ክሳቸውን አቃቤ ህግ ሲያንቀሳቅስ እና መጥሪያ ከደረሳቸው በኋላ በድጋሚ ወደ እስር ቤት ተመልሰው የፌደራሉ ከፍተኛ ፍርድ ቤት ጉዳያቸውን መከታተል እንደሚጀምሩ ይጠበቃል።

የዶ/ር መረራ ጉዲና መታሰር በሃገሪቱ ያለውን የፖለቲካ ውጥረት ወደ አለመረጋጋት ሊወስደው እንደሚችል አምነስቲ ኢንተርናሽናል ገለጸ

የኢትዮጵያ መንግስት ዶ/ር መረል ጉዲናን ለእስር መዳረጉን በሃገሪቱ ያለውን የፖለቲካ ውጥረት ወደ አለመረጋጋት ሊወስደው እንደሚችል አምነስቲ ኢንተርናሽናል ሃሙስ ገለጸ። የኦሮሞ ፌዴራሊስት ኮንግሬስ (ኦፌኮ) አመራር በቁጥጥር ሾር መዋላቸው ሃሳብን በነጻነት የመግለጽ መብት ላይ የተካሄደ አፈና ነው ሲሉ የሰብዓዊ መብት ተሟጋቹ የምስራቅ አፍሪካ ምክትል ሃላፊ የሆኑት ሚቼሌ ካጋሪ አስታውቀዋል። መንግስት የወሰደው ዕርምጃም በሃገሪቱ ያለውን ውጥረት እንደሚያባብሰው ያሳሰቡት ተወካዮዋ እርምጃው በኢትዮጵያ ያለውን ሁኔታ ለሚከታተሉ አለም አቀፍ አካላት ጥሪን ያስተጋባ ነው ሲሉ አክለው ገልጸዋል።

አምነስቲ ኢንተርናሽናል ለአንድ አመት ያህል ጊዜ በኦሮሚያ ክልል በዘለቀውና በቅርቡ ወደ አማራ ክልል ከተዛመተው ህዝባዊ ተቃውሞ ጋር በተገናኘ ከ700 በላይ ሰዎች መገደላቸውን ሲያሳውቅ ቆይቷል። በስልጣን ላይ ያለው ገዢው የኢህአዴግ መንግስት በሃገሪቱ ያለውን የሰብዓዊ መብት ረገጣ ትርጉም ባለው መልኩ ትኩረት ሊሰጠው እንደሚገባ የሰብዓዊ መብት ተሟጋች ድርጅቱ አክሎ አሳስቧል።


ዶ/ር መረል ጉዲና ለእስር በተዳረጉበት እለት የአስቸኳይ ጊዜ አዋጁን ተግባራዊነት የሚከታተለው የኮማንድ ፖስቱ ሃላፊ እና የመከላከያ ሚኒስትሩ ሲራጅ ፈርጌሳ አዋጁ በሃገሪቱ ላሉ የተቃዋሚ ፓርቲዎች ምቹ ሁኔታን ፈጥሯል ሲሉ መግለጫ መስጠታቸው ይታወሳል።


የሂውማን ራይትስ ዎች ተመራማሪ የሆኑት ፊሊክስ ሆንር በበኩላቸው የኢትዮጵያ ባለስልጣናት ጥያቄ እያነሱ ካሉ አካላት ጋር ውይይት ይካሄዳል ሲሉ ቢገልጹም እያካሄዱት ያለው ነገር የተቃረነ ነው በማለት ለዋሽንግተ ፖስት ጋዜጣ አስረድተዋል።

Dear Federica

Thank you for your reply of 29 November 2016 to my letter concerning the state of emergency decreed by the Ethiopia and the human rights situation in the country. Despite your efforts to request the Ethiopian government to address the grievances of the population, open democratic space and respect the population’s fundamental freedom, the government is not listening.

And the latest evidence of that is in the sad news that Dr. Merera Gudina, a former MP and leader of the Oromo People’s Congress, was arrested yesterday at Bole airport in Ethiopia upon arrival from Europe. I was also informed that his residence was raided by security forces and that at least two of his close family members were taken in custody.

The apparent reason for the arrest was his participation in a hearing at the European Parliament, which I hosted, and where he sat next to the Ethiopian athlete Feyisa Lilesa and Dr. Berhanu Nega. Government affiliated media in Ethiopia accused Dr. Merera Gudina of “crossing the red line” for sitting at the meeting with opposition leader Dr. Berhanu Nega, who is considered a “terrorist” by the Ethiopian government. There are reports that the government-affiliated media circulated pictures of the hearing and implied that he violated both the state of emergency decree and the so called Ethiopian Anti-Terrorism Law by meeting someone that the Ethiopian government designated as terrorist.

Dr. Merera Gudina come to the European Parliament at my invitation to speak about the situation in Ethiopia, which is of direct concern to European parliamentarians and institutions, given the strong ties between the European Union and Ethiopia and the fact that Ethiopia is the single biggest recipient of EU development aid in Africa. For these reasons, he also met with the cabinet of President Schulz and with the External Action Service.

It is unacceptable that Dr. Merera Gudina was detained upon arrival in Ethiopia, and his arrest demonstrates the government’s absolute disregard of human rights, namely freedom of speech. It should serve as an indication that the Ethiopian government has no intention to open up democratic space in the country nor to heed your calls for inclusive dialogue.

A more stringent approach is necessary from EU towards the Ethiopian government. Failing to do so will only aggravate the violence in the country, which can easily escalate into civil war. I am extremely concerned about the detention of Dr. Merera Gudina and his relatives, and believe that he is at risk of being submitted to torture and other ill-treatment. I therefore hope that you will adamantly press for his immediate release and condemn his arrest as blatant violation of international human rights norms, which Ethiopia is bound to uphold, namely under the Cotonou Agreement.
